While the trend in Europe is to render decisions that are coming down hard on what is considered illegal content on websites, Germany is taking another path entirely. German courts are increasingly siding with the websites to allow them to continue operations even when the content is illegal in Germany.
With the recent UK ISP ruling seemingly kick-starting an avalanche of similar court orders, as we’ve seen this week in the Netherlands and Finland, the announcement from German courts is certainly refreshing.
